OVERVIEW

The State Board of Dental Examiners (Board) adopts this amendment to 22 TAC §101.2, concerning dental licensure by examination. The adopted amendment reflects the North East Regional Board of Dental Examiners (NERB) name change to The Commission on Dental Competency Assessments (CDCA), and the effective date of the name change. This amendment is adopted without changes to the proposed text as published in the April 30, 2021, issue of the Texas Register (46 Tex Reg 2882). The rule will not be republished.

BACKGROUND AND JUSTIFICATION

This rule is adopted under Texas Occupations Code §254.001(a), which gives the Board authority to adopt rules necessary to perform its duties and ensure compliance with state laws relating to the practice of dentistry to protect the public health and safety.

HHSC proposes to increase the per diem rate for Pediatric Long-term Care Facilities to $383.08, effective September 1, 2021.

BACKGROUND AND JUSTIFICATION

The rate increase is proposed in order to comply with the 2022-2023 General Appropriations Act, Senate Bill (S.B.) 1, 87th Legislature, Regular Session, 2021, (Article II, HHSC, Rider 40), which requires a rate methodology revision for pediatric long-term care facilities to mirror Medicare rates. HHSC intends to revise the rate methodology published in Title 1 of the Texas Administrative Code, §355.307, relating to Reimbursement Setting Methodology, in accordance with Rider 40 so that the rate for all facilities in this special reimbursement class of nursing facilities will be based upon the unadjusted federal per diem rate for rural Medicare skilled nursing facilities for the most recent federal fiscal year. HHSC also intends to propose a new rule as part of this methodological revision.

Notice of Public Hearing on Proposed Reimbursement Adjustments for Hospital Quality-Based Program Potentially-Preventable Readmissions

The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on July 15, 2021, at 9:00 a.m., to receive public comments on the proposed use of unweighted potentially preventable readmission (PPR) results to assess hospital performance and potential reimbursement reductions.

The purpose of this amendment is to revise HHSC’s potentially preventable events program for reimbursement reductions for eligible hospitals. With the revision, HHSC would no longer weight potentially preventable readmissions when calculating a hospital’s performance in relation to statewide norms. The reimbursement adjustments are proposed to be effective September 1, 2021.

The proposed change in methodology is in accordance with the findings of Senate Bill (SB) 1207, 86th Legislature, Regular Session, 2019, which required HHSC to evaluate risk-adjustment methods used for PPRs. Based on this investigation, staff determined that hospitals treating a high proportion of STAR Kids members (who because of their medical complexity are more likely to have multiple readmissions associated with a single initial hospital stay) are likely disadvantaged by the current method for calculating risk-adjusted PPR rates.

HHSC intends to submit an amendment regarding reimbursement methodologies for the Texas State Plan for Early and Periodic Screening, Diagnosis and Treatment Comprehensive-Care Program (EPSDT-CCP)

OVERVIEW

The Texas Health and Human Services Commission (HHSC) announces its intent to submit an amendment to the Texas State Plan for Early and Periodic Screening, Diagnosis and Treatment under Title XIX of the Social Security Act. The proposed amendment is effective September 1, 2021.

The purpose of the amendment is to update School Health and Related Services (SHARS) pages within the Reimbursement Methodologies for Early and Periodic Screening, Diagnosis and Treatment Comprehensive-Care Program (EPSDT-CCP) section of the state plan. The amendment will add the costs of audiology services prescribed to Medicaid-enrolled students with Section 504 Plans to the costs that may be reimbursed under the SHARS program.
